Terms and Conditions
1. Introduction
These Terms and Conditions (“Terms”) govern your membership of the Family Law Section (“Section”) of the Law Council of Australia Limited (“Law Council”, “we”, “us”, “our”). By submitting an application for membership, renewing your membership, or using Section services or benefits, you agree to be bound by these Terms and our By-laws.
These Terms are subject to applicable law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), and other regulatory obligations.
2. Membership Eligibility
2.1 Eligibility: All legal practitioners are eligible to apply for membership of the Family Law Section. Other categories may be eligible as determined by Section Executive and will be listed on our website from time to time.
2.2 Application: Membership applications must be submitted with accurate information. We reserve the right to verify details as necessary.
2.3 Acceptance: Membership is effective once we confirm acceptance and you complete payment of any applicable fees.
3. Membership Year
Membership commences once your application is accepted and paid, and runs from 1 July to 30 June each year (“Membership Year”).

5. Fees, Payments and Refunds
5.1 Fees: Membership fees and payment terms are published on the Section’s website or notified to applicants.
5.2 Payment: By applying for membership, you agree to pay the applicable fees by the due date.
5.3 Refunds:
Membership fees are non-refundable and non-transferable once payment is made.

Any refund decision will be at the Section’s discretion, except to the extent that your rights under the Australian Consumer Law cannot be excluded, restricted or modified.
5.4 Consumer Guarantees:
Nothing in these Terms is intended to exclude, restrict or modify consumer guarantees or other rights that cannot lawfully be excluded under the Australian Consumer Law.
6. Member Benefits
6.1 Members may access member benefits as outlined on the Section’s website, which may include:
- access to resources in the password-protected Membership Library,
- invitations to events, seminars, newsletters,
- other professional benefits.
6.2 We may modify, remove or replace member benefits at any time.
7. Digital Platform and Account Security
7.1 Access to digital resources (e.g., Membership Library) is via individual login credentials. You must keep passwords secure and not share access. Membership is individual, not by organisation.
7.2 You agree to notify us immediately if you suspect unauthorised use of your account.
7.3 We reserve the right to suspend access where we reasonably suspect misuse.
8. Privacy and Personal Information
8.1 Personal information will be collected, held, used and disclosed in accordance with our Privacy Policy and the Privacy Act 1988 (Cth), including the Australian Privacy Principles.

- how long we retain it,
- how you can access, correct or complain about handling of your information.
8.3 The Privacy Policy also includes details about:
- cross-border disclosures,
- the Notifiable Data Breaches scheme, and
- your rights under the Spam Act 2003 (Cth) for marketing communications.
9. Intellectual Property
9.1 All intellectual property rights in Section materials, publications and digital content remain owned by us or our licensors.
9.2 Members may use materials for personal, non-commercial purposes only, unless otherwise authorised in writing.
10. Limitation of Liability
10.1 To the extent permitted by law, we exclude all warranties, conditions or other terms implied by statute or common law.
10.2 In no event will liability to a member exceed the amount of the membership fee paid in the relevant Membership Year.
10.3 Nothing in this clause limits liability for death or personal injury arising from negligence where such limitation is prohibited by law.
11. Termination and Suspension
11.1 We may suspend or terminate membership where:
- a member breaches these Terms,
- conduct is harmful to the Section or its reputation,
- a member fails to pay fees when due.
11.2 Members may terminate their membership by giving written notice; termination does not automatically entitle a refund unless required by law.
12. Variation of Terms
We may vary these Terms at any time by notice on the Section’s website or by direct communication to members.
Continued membership after variation constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Australian Capital Territory, Australia. You submit to the exclusive jurisdiction of the courts of that jurisdiction.

Privacy collection statement
The Law Council of Australia Limited (the Law Council) respects your privacy. We handle your personal information in accordance with our Privacy Policy and our obligations under the Australian Privacy Principles (APPs), as set out in the Privacy Act 1988 (Cth).
We collect your personal information to process or renew your membership and for purposes related to your membership, including providing you with information about matters relevant to the activities of the Law Council and its Constituent Bodies (CBs) (the 16 Australian state and territory law societies and bar associations and Law Firms Australia Limited), such as upcoming conferences and events, and providing you with information about the legal profession.
Your personal information may be disclosed to people or bodies who provide services to or support the operations of the Law Council, such as contractors and service providers, including for the purpose of processing and administering your application and providing services and benefits to you as a Section member.
If you consent, your personal information may also be disclosed to CBs for the purpose of membership opportunities and offers from CBs. The personal information provided to CBs for this purpose is limited to your name, contact details, Section of membership and state or territory in which you practice.
If you do not provide all of the personal information requested, the Law Council may not be able to process or renew your application.
The Law Council does not ordinarily disclose your personal information to overseas recipients.
